In order to use any of the products from under the NSHIFTED trademark, please take a moment and revise our policy. The following Terms of Use govern your access and use of NSHIFTED’s products. Please read these Terms of Use carefully before using any of the NSHIFTED products. Also, specific terms and conditions may apply to specific products. Such specific terms may be in addition to these Terms of Use or, where and then only to the extent expressly specified, may supersede these Terms of Use. By using, purchasing or installing the NSHIFTED products, systems or components, the user is deemed to agree with and accept the terms and conditions below.
When used in these Terms of Use, “we”, “our” and “us” means NSHIFTED, and “you”, “your”, “user” and “customer” refers to any individual, company or legal entity that accesses, purchases or otherwise uses NSHIFTED’s products.
You acknowledge that all content on this website and the products under NSHIFTED name, including design, graphics, text, formatting, sounds, pictures, images, software, hardware, accessories and other materials and information inside the NSHIFTED environment, and the selection and arrangement thereof (collectively, “content”), are the property of NSHIFTED or its licensors, and are subject to and protected by United States and international copyright and other intellectual property laws and rights. All rights to content not expressly granted in these Terms of Use are reserved to their respective intellectual property right owners. Except as expressly authorized in these Terms of Use or on the website, you may not copy, reproduce, distribute, republish, download, perform, display, post, transmit, exploit, create derivative works or otherwise use any of the content in any form or by any means, without the prior written authorization of NSHIFTED or the respective intellectual property rights owner. NSHIFTED products may provide references or links to other companies, products, or websites for your convenience and information. These parties may operate independently from us. We may collect and store personal information that you choose to voluntarily provide to us when you contact us, or personal information required upon interacting with NSHIFTED, like when purchasing one of our products. Personal information may include your name, email address, telephone number or address. We use the information you provide so you can benefit from our products and to make your interaction with NSHIFTED as reliable as possible. We may also use the information to communicate with you.
We do not sell or otherwise disclose personal information we collect about you, except as described herein or otherwise disclose to you at the time the data is collected. We may disclose information about you as compelled or required by law, to law enforcement authorities or other government officials, to protect or defend our legal rights, or in order to investigate, prevent or take action regarding illegal activities, suspected fraud, or violations for our Terms and conditions for using our products. We also reserve the right to transfer personal information we have about you in the event that we sell or transfer all or a portion of our business assets.
The security of information is important to us, and we are committed to using reasonable measures to protect the personal information we may collect. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and us or the information stored is absolutely secure.
NSHIFTED is the sole entity entitled to repair or replace any defective products or components for the entire life span of the vehicle on which they were originally installed by the initial owner – for the ECU, and 1-year life span of the vehicle on which they were originally installed by the initial owner – for the Pressure Sensors and Manifold block, provided that the products or components were installed correctly and exactly as instructed herein, not modified or altered, and operated as expressly intended by NSHIFTED. Upon the return of a failed component(s) at customer’s expense, NSHIFTED will determine the cause of failure and notify the customer about the next course of actions. In case of failure due to defectively manufactured parts, then NSHIFTED will either repair or replace the failed components at their own discretion and in a timely manner. If the failure occured due to improper installation or misuse of the system – as determined by NSHIFTED, a repair charge will be assessed and the customer will be contacted before work is performed or replacement parts are shipped.
Each package shipped to NSHIFTED for repair or return reasons must be previously mentioned and communicated to NSHIFTED via any means of contact available. If not done so, NSHIFTED reserves the right to reclaim the package. In case of repair, NSHIFTED will assess the situation and provide further details regarding the issue, charges & costs, shipping and duration of the repair. NSHIFTED reserves the right to take as much time as needed in order to solve the problems. In case of returning a product or component, the customer will be eligible for a full refund, providing the product or component is in the same condition as shipped, not damaged or altered in any shape or form, and returned (shipped to us) within 2 weeks from receiving it.
We offer door-to-door shipping using DPD, TNT or DHL. The rates vary from 25 EUR / 30 USD (Europe) to 75 EUR / 90 USD (remote locations) or more depending on the destination, shipping method and package size and weight. Shipping time is usually 1 to 3-7 days. We do ship in 1 to 2 days upon receiving the order, unless specified otherwise. Please keep in mind additional shipping, VAT or customs taxes may apply and shipping time may also be affected, depending on the law and government of the destination country.
The current ways of payment are instant credit card transaction payment using Paylike, Direct Bank Transfer or Cryptocurrency. Please keep in mind additional taxes may apply. The payment is done during the process of placing the order – in case of using Paylike, or after the order has been placed – in case of Direct Bank Transfer and Cryptocurrency. Shipping process starts after the funds has been cleared to our account.
NSHIFTED products should be used with caution. If a customer chooses to use NSHIFTED products in a potential hazardous situation, the customer understands that they do so at their own risk. NSHIFTED’s products must be installed by a qualified professional installation facility, as recommended by NSHIFTED. NSHIFTED’s products may void or limit any manufacturer’s warranty or service contract covering customer’s vehicle or other parts of the vehicle. NSHIFTED shall have no liability for any effect that installation of its products may have on such warranties or service contracts. NSHIFTED’s products may drastically alter the performance characteristics of customer’s vehicle or other vehicle parts and may cause it to operate in a manner not intended by the original manufacturers. System operation and installation is at the customer’s own risk. The customer is responsible for periodically inspecting any and all NSHIFTED products or components installed on customer’s vehicle, to ensure they remain safe and functional. NSHIFTED shall have no liability for any loss or injury caused by customer’s failure to inspect. NSHIFTED shall have no liability for damage to property or persons caused by its products, components, accessories, installation instructions, or otherwise. Customer alone assumes all such risks and liabilities. NSHIFTED accepts no responsibility for systems, products or components provided by other manufacturers for use with or around the NSHIFTED system. For components other than NSHIFTED’s, follow the manufacturer’s instructions for installation and operation. NSHIFTED’s liability, if any, shall be limited to the replacement cost of the purchased product or component. Any and all disputes between NSHIFTED and customer relating to the purchase or installation of an NSHIFTED product or component must be resolved through final and binding arbitration, applying the laws of Romania. Arbitration shall take place in Timisoara, Romania, and customer consents to personal jurisdiction in Timisoara. No part of the vehicle should be able to contact the ground when all air is out of the air springs.
Neither NSHIFTED or its affiliates shall under any circumstances be liable for any damages of an kind arising out of, in connection with or relating to your access to, or use of or inability to use the NSHIFTED products or any other material under the NSHIFTED trademark, or any other piece of content or information you access through NSHIFTED environment, or any incorrect or inaccurate information. This is a comprehensive limitation of liability that applies to all damages of any kind, including any direct, indirect, special, incidental or consequential damages (including but not limited to property damage, loss of use, loss of data, loss of business, economic loss or loss of profits), wheter based on breach of contract, breach of warranty, tort (including negligence) or otherwise, even if NSHIFTED has been advised of the possibility of such damage or loss. To the maximum extent permitted by applicable law, you expressly waive all claims agains NSHIFTED and its affiliates that may arise from your access or use of the NSHIFTED products.
By interacting with NSHIFTED, either via browsing this website, using the NSHIFTED mobile app or any other NSHIFTED products, you agree to be bound by these Terms of Use and all terms and conditions contained or referenced herein or any additional terms and conditions set forth on this website. If you do NOT agree to all of these terms, you should NOT access, purchase or use the products from under the NSHIFTED trademark.
These Terms of Use may be amended by NSHIFTED, in its sole discretion, at any time without notice. Such amended Terms of Use shall be effective upon posting. By continuing to use the NSHIFTED products, you will be deemed to have accepted such amendments. You are advised to regularly review any applicable terms and conditions. NSHIFTED reserves the right to discontinue or make changes or updates with respect to any of its products at any time without notice.
